Challenges in Environmental Compliance and Enforcement

This session will promote a dynamic dialogue among high-level environmental law experts on effective compliance and enforcement of environmental law and policies, as critical elements to address the unprecedented global challenges posed by climate change, biodiversity loss, pollution and other forms of environmental degradation.

In the context of the COVID-19 pandemic, concerns about economic growth can increase the risk of regression and can hinder effective compliance and enforcement of environmental law and policies. In this context, as stated in the 2016 IUCN World Declaration on the Environmental Rule of Law, measures to ensure effective compliance with laws, regulations, and policies, including adequate criminal, civil, and administrative enforcement, liability for environmental damage, and mechanisms for timely, impartial, and independent dispute resolution, are among the key governance elements upon which environmental rule of law is premised and are indispensable requisites to protect both nature and human rights dependent on nature.
